FIVE THINGS YOU SHOULD KNOW ABOUT THE NEW MICHIGAN MARIJUANA LAW

On November 6th, 2018 Michigan voters voted to allow Michigan residents (age 21 and above) to use marijuana. The law authorizing recreational use of marijuana went into effect on December 6, 2018.  The law is 13 pages long!

Here are some highlights of some of the key points about the law in the blog below. In particular, we highlight what the law allows.

1. To possess and use marijuana, the person has to be over 21 years of age. It is not legal for someone younger than this to grow, possess, or use marijuana.
2. 2. Anyone who is 21 years of age or older can possess up to 2.5 ounces of marijuana outside of their home.
3. Inside a household, a person can possess up to ten ounces of marijuana. “Inside the home, the marijuana needs to be locked.  This can mean different things to different people.  I will be suggesting to my clients that they keep their marijuana locked in a safe of some kind or a lock box.  This will prevent the marijuana from getting into the hands of children or young adults that shouldn’t have access to it,” Mike Van Tubergen advised.
4. Under the new law, you can give marijuana away as a gift but you are not allowed to sell it.
5. People can also grow their own marijuana. “People can have up to 12 plants in their home.  This does not count against the ten ounces of marijuana they are allowed to have stored in their home,” Van Tubergen added.  However, each household is limited to 12 plants and 10 ounces. For example, “a husband and wife, or roommates cannot double dip”  The total is for a household not an individual.  Hence “if you have 10 adults over the age of 21 in a household, the household cap remains 10 ounces.”
